Visa Types For International Seasonal Employees

A great number of jobs in American businesses are filled by Americans. Still, there is a shortage of seasonal labor force. A lot of employers have begun to rely on foreign workers to fill the entry-level seasonal job void. There are two options for making up for the labor shortage: filing for H-2B visas or employing J-1 student visa workers. Both visa types help to fill a temporary need for unskilled entry-level employers. In the recent years, hiring H-2B visa employees has been of importance for local, seasonal, service industry companies, such as hotels, restaurants, landscaping and construction outfits. A total of 33, 000 H-2B visa workers are admitted to the country every season. H-2B visa holders come to the States twice a year: from October 1 to March 31 (winter season) and from April 1 to September 30 (summer season). With two seasons allowing 33, 000 employees each, a total cap of 66, 000 H-2B visas is issued nationwide annually. Because of the complex nature of the H-2B visa application procedure and the current limitation on its usage, some businesses are looking for J-1 student workers instead. There are no limits on the number of J-1 visa workers coming to the States. Workers can have more than one employer and there is minimum paperwork to be done by an employer. The student completes all visa forms in their fatherland and is either sanctioned or denied there. Employing J-1 student workers has proven to be a perfect solution to a labor shortage. For many employers they are a viable alternative. However, J-1 visas have the downside. J-1 student visa workers are only permitted to work 4 months a year - the period that corresponds to their summer holidays. Student employees work for about 90 days, starting from June/May, and then travel for a month - the so-called grace period - before leaving for their home counties. Thus, J-1 student visa holders can lawfully reside in the United States for about four months in total. For H-2B and J-1 visa holders the Work & travel USA Program is a chance experience the "true" USA not as a tourist but as a paid employee.
